The website may provide a form that helps individuals express interest in employment at an independently owned salon. Where the form states that information will not be stored by FS Cut & Colour, the information is intended to be routed to the selected independently owned salon or its authorised recruiting provider. The salon is responsible for its subsequent handling of the information.

7. Consent and Other Lawful Authority
We collect, use and disclose personal information with consent, except where applicable law permits or requires otherwise. Consent may be express or implied, depending on the sensitivity of the information, the purposes, the circumstances and your reasonable expectations. In some situations, the law allows us to collect, use or disclose personal information without consent.

By voluntarily providing personal information for an identified purpose, you consent to our handling of the information for that purpose and for other purposes that would be reasonably apparent in the circumstances.
You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal may affect our ability to provide a requested service or complete a transaction. To withdraw consent, contact Privacy@fantasticsams.com or use the preference controls made available to you.
8. Marketing Communications and Canada’s Anti-Spam Legislation

We send commercial electronic messages only where permitted by applicable law. Where required, we obtain express or implied consent before sending promotional emails, text messages or other commercial electronic messages.
Our commercial electronic messages will identify the sender, provide required contact information and include a functioning unsubscribe mechanism. You may unsubscribe by using the instructions in the message. We will process unsubscribe requests within the period required by law.
You may continue to receive non-promotional communications that are necessary to respond to a request, administer an account, complete a transaction, provide a requested service or meet a legal obligation.
Consent provided directly to an independently owned salon may apply only to that salon. Unsubscribing from corporate communications may not unsubscribe you from communications independently sent by a salon, and vice versa.

Where required by applicable law, non-essential technologies will not be activated until appropriate consent has been obtained. You may manage available choices through the website’s cookie settings, your browser or device settings, or applicable platform controls.
To learn more or opt out of tailored advertising, you may use the Digital Advertising Alliance of Canada’s opt-out resources.
9.2 Google Analytics
Our website uses Google Analytics, a web analytics service of Google, or comparable technology. Google Analytics uses cookies and similar technologies to help analyse how users interact with the website. Google may process or disclose information in accordance with its own terms and privacy practices. Users may adjust browser or consent settings and may use Google’s available analytics opt-out tools, although disabling certain technologies may affect website functionality.
10. How We Disclose Personal Information
We may disclose personal information as described below, with consent, or as otherwise permitted or required by law.
10.1 Independently owned salons, franchisees and subfranchisors
We may disclose information to an independently owned salon, franchisee or subfranchisor when needed to route an inquiry, facilitate a salon-related request, administer a programme, support franchise-system operations or provide another requested service. These businesses may be independently responsible for their subsequent handling of the information.

We may use service providers for website hosting, cloud storage, form processing, customer relationship management, email and text messaging, analytics, advertising, information technology, cybersecurity, professional advice and other business functions. They may access personal information only as needed to perform authorised services and are expected to protect it appropriately.
10.4 Advertising and analytics providers
Subject to applicable consent requirements, we may disclose online identifiers, device information, cookie or SDK information and usage information to analytics and advertising providers to measure performance, understand engagement, limit repeated advertisements or provide relevant advertising.
10.5 Business transactions
We may disclose personal information in connection with a proposed or completed merger, acquisition, financing, reorganisation, sale of assets, insolvency proceeding or other business transaction. We will limit disclosure to what is reasonably necessary and use protections required by law.

Fantastic Sams Franchise Corporation is located in the United States, and some of our affiliates and service providers may be located outside Canada. Personal information may therefore be transferred to, stored in or processed in the United States or another jurisdiction.
When personal information is processed outside your province or outside Canada, it may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement agencies, regulators or other authorities under local law. Privacy protections in another jurisdiction may differ from those in Canada.
Where we transfer personal information outside Canada or Quebec, we use contractual, administrative, technical or other safeguards appropriate to the sensitivity of the information and the nature of the processing. 12. Retention and Destruction
We retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected, provide requested services, maintain business and transaction records, resolve disputes, enforce agreements, protect against fraud or security incidents, and comply with legal, tax, accounting and regulatory obligations.

Backup copies may remain until overwritten or securely deleted under our normal backup processes.
For Quebec residents, if personal information is anonymized, we will comply with applicable Quebec laws and regulations governing anonymization.
13. Accuracy
We take reasonable steps to ensure that personal information under our control is accurate, complete and up to date as necessary for the purposes for which it is used. You are responsible for providing accurate information and notifying us when it changes.
14. Security Safeguards
We use administrative, technical and physical safeguards appropriate to the sensitivity, amount, format and storage of personal information. These may include access controls, authentication, encryption where appropriate, vendor oversight, staff confidentiality obligations, system monitoring, secure transmission, incident-response procedures and secure destruction practices.
The categories of individuals within our organisation who may access personal information include employees in Marketing, Legal and Technology, and other personnel who require access to perform authorised business, legal, technology, finance, human resources or support functions.
No method of transmission or storage is completely secure. Although we take reasonable steps to protect personal information, we cannot guarantee absolute security.
15. Privacy Incidents
We maintain procedures for responding to suspected loss, unauthorised access, use or disclosure of personal information. Where required by applicable law, we will investigate, contain and remediate the incident, notify affected individuals, report to the appropriate privacy commissioner or regulator, and maintain required records.
16. Accessing and Correcting Personal Information
Subject to applicable exceptions, you may request access to personal information we hold about you and request correction of information that is inaccurate or incomplete. You may also ask how we have used the information and to whom it has been disclosed, where required by law.
Requests must be sent to Privacy@fantasticsams.com. We may request information reasonably necessary to verify your identity and locate the relevant records. We will respond within the period required by applicable law.
Access may be limited or refused where permitted or required by law, including where disclosure would reveal personal information about another person, confidential commercial information, information protected by legal privilege, or information that cannot be disclosed for security or legal reasons. Where we refuse a request, we will explain the reason, subject to legal restrictions.

If you believe personal information we hold about you is incorrect, incomplete or inaccurate, you may request that we amend it. We will consider whether the information requires amendment. If we do not agree that there are grounds for amendment, we may note your disagreement where required by law.
